Terms of service

1. Your account

• You must provide accurate information and keep your sign-in credentials secure. You are responsible for activity under your account and for the team members you invite.
• You must be at least 16 and able to enter a binding contract. If you accept these terms for an organisation, you confirm you can bind it.

2. Acceptable use

• Only measure websites and apps you own or are authorised to measure, and give your visitors any notice or consent choices the law requires.
• Do not use the service to collect sensitive data (such as health data or government ID numbers) in event properties, or to identify visitors without a lawful basis.
• Do not attack, overload, reverse-engineer or resell the service, or send data you have no right to send.

3. Your data

You own the data you and your websites send to Realific. You grant us the rights needed to host, process and display it to provide the service. For visitor analytics you are the controller and we are your processor; our Data Processing Agreement (realific.app/legal/dpa) forms part of these terms.

4. Plans, billing and usage

• Plans are billed in advance, monthly or yearly, through Polar (our merchant of record), and renew automatically until cancelled. Prices are in US dollars and taxes are added where required.
• Each plan includes a monthly event allowance chosen by tier. If you go over it, tracking continues for a 7-day grace period; after that the dashboard asks you to move up a tier. Data is still collected for 30 days and never silently dropped.
• You can change plan or tier, or cancel, at any time from the billing page. Cancellation takes effect at the end of the paid period. Except where the law requires, fees already paid are not refunded.
• We may change prices with at least 30 days’ notice; changes apply from your next billing period.

5. Free trial

Every new account gets a 14-day free trial of the Growth plan. No payment method is needed. When it ends without a subscription, the dashboard is locked until you choose a plan; we keep collecting data for 30 days, then stop. The trial is provided as it is and may be changed with reasonable notice.

6. Third-party services

If you connect Google, Stripe, Lemon Squeezy, Paddle, Polar, Shopify or another service, your use of it is governed by that provider’s terms. We access it only as you authorise, and you can disconnect at any time.

7. Availability and changes

We work to keep the service available and fast, but we do not guarantee it will be uninterrupted or error-free. We may improve or change features; if we remove a material paid feature, we will give notice and you may cancel.

8. Suspension and termination

You may stop using the service and delete your account at any time. We may suspend or end access if you breach these terms, fail to pay, or create a security or legal risk, and we will give notice where reasonable. After termination you can export your data for 30 days, after which it is deleted.

9. Disclaimers

Analytics and revenue attribution are estimates based on the data your websites send. The service is provided “as is” to the extent the law allows, without warranties of fitness for a particular purpose or accuracy of results.

10. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental or consequential damages, or lost profits or data, and each party’s total liability is limited to the fees you paid in the 12 months before the claim. These limits do not apply to fraud, wilful misconduct, or your payment obligations.

11. Indemnity

You will defend us against claims arising from data you send that you had no right to send, or from your breach of section 2.

12. General

These terms are governed by the laws of the jurisdiction in which Realific’s operating entity is established, without regard to conflict-of-laws rules. If any part is unenforceable, the rest remains in effect. We may update these terms; we will post changes here and email account owners about significant ones at least 30 days before they apply.
